Clear Guidelines for a Trusted Partnership
Please review our Terms & Conditions to understand the guidelines, responsibilities, and expectations that apply when using New Era MBS services and website. Our goal is to maintain transparency, professionalism, and a clear understanding with every client and website visitor.
1. Acceptance of Terms
By accessing the website newerambs.com or by signing a service agreement to utilize our professional medical billing, coding, credentialing, or administrative services, you (the "Client" or "Healthcare Provider") agree to be legally bound by these Terms and Conditions. If you do not agree to these terms, you must immediately cease using our platform and services.
2. Scope of Services
New Era MBS provides third-party administrative support including, but not limited to, medical claims processing, data entry, electronic claims submission, rejection/denial management, and patient statement billing. New Era MBS acts solely as an independent contractor agent. We do not practice medicine, provide medical advice, or take responsibility for clinical decisions. We rely entirely on the coding, diagnostic, and encounter data provided to us by the Client.
3. Client Responsibilities & Data Accuracy
The accuracy of all submissions depends entirely on the data provided by your practice. Accuracy Guarantee: The Client is solely responsible for verifying the accuracy, truthfulness, and completeness of all patient encounter forms, ICD-10/CPT codes, demographics, and insurance data uploaded to us. Compliance: The Client warrants that all services billed are medically necessary and documented accurately within the patient's medical records. New Era MBS is not liable for claims delayed or denied due to inaccurate information provided by the Client.
4. Fees, Invoicing and Payment Terms
Service Fees: Fees for our billing services are calculated based on the specific percentage of collected revenue or flat-rate structures agreed
upon in your signed Service Agreement.
Invoicing: Invoices are generated monthly and are due upon receipt or within the timeframe specified in your contract.
Late Payments: New Era MBS reserves the right to temporarily suspend billing operations, claims submissions, or portal access for any accounts with invoices past due by more than thirty (30) days.
5. HIPAA Compliance & Business Associate Agreements (BAA)
Both parties agree to fully comply with the Health Insurance Portability and Accountability Act (HIPAA) guidelines. New Era MBS will execute a separate Business Associate Agreement (BAA) with the Client prior to processing any Protected Health Information (PHI). We maintain stringent electronic and physical administrative protocols to keep your practice and patient data secure.
6. Limitation of Liability
To the maximum extent permitted by law, New Era MBS, its directors, employees, or agents shall not be held liable for any indirect, incidental, special, or consequential damages resulting from:
Lost revenues or profits due to insurance payer delays, technical clearinghouse outages, or changes in regional payer rules.
Government or insurance audits resulting from fraudulent coding or insufficient medical documentation maintained by the Client’s practice.
7. Intellectual Property
All content, logos, custom software integrations, website graphics, layouts, and text displayed on newerambs.com are the exclusive intellectual property of New Era MBS. Unauthorized reproduction, modification, or distribution of this material is strictly prohibited.
8. Termination of Agreement
Either party may terminate the business relationship according to the specific cancellation terms established in their individual signed contract (typically requiring a 30-day or 60-day written notice). Upon termination, New Era MBS will return or securely destroy patient data files in full accordance with HIPAA data-retention laws.
9. Governing Law
These Terms and Conditions shall be governed by, construed, and enforced in accordance with federal healthcare regulations and the state laws under which New Era MBS operates its primary corporate registration.
